Welcome to My Senior Health Plan (“MSHP,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the websites, pages, landing pages, forms, and digital properties that link to these Terms (collectively, the “Site”). By using the Site, you agree to these Terms.
If you do not agree, do not use the Site.
1) Who We Are & Non‑Affiliation with Government
MSHP is an independent insurance agency/brokerage. We are not affiliated with, endorsed by, or acting on behalf of the U.S. government, the Centers for Medicare & Medicaid Services (“CMS”), or the Medicare program. References to “Medicare,” “CMS,” and related program names are for identification and educational purposes only. Use of government names, logos, or references must not be misleading or imply endorsement. (See CMS final rule commentary regarding misleading advertisements and misuse of Medicare name/logo.)
2) Informational Nature of Site Content (No Plan‑Specific Advice Here)
The Site provides general educational information and is not legal, tax, medical, financial, or plan‑specific advice. Where plan‑specific guidance is appropriate, it will be provided by a licensed agent only after required compliance steps are satisfied (e.g., Scope of Appointment where applicable) and using current plan‑year information. CMS defines “marketing” versus broader “communications,” and applies requirements to any marketing materials or activities.
3) CMS Marketing Rules — We Follow Them
MSHP and its agents follow CMS marketing requirements, including but not limited to:
- No cash or monetary rebates as enrollment inducements; nominal gifts only when compliant, not in cash or cash equivalents.
- No meals at marketing events and no cross‑selling non‑healthcare products during Medicare sales activities.
- No misleading plan comparisons; any comparisons must be accurate and supportable.
- OEP restrictions (e.g., no unsolicited marketing to MA/PDP enrollees during OEP, with limited exceptions).
4) Beneficiary Contact, Consent to Contact, and Unsolicited Outreach
We will not engage in prohibited unsolicited contact. Specifically:
- We do not conduct unsolicited door‑to‑door visits; we do not approach beneficiaries in common areas; and we do not send unsolicited direct social media messages.
- We do not cold‑call, robo‑call, text, or leave sales voicemails without prior consent (including calls based on referrals).
- Calls are not “unsolicited” when you provide consent or initiate contact (e.g., form submission, inbound call, business reply card). By providing contact information on the Site, you authorize MSHP to contact you by phone, text, email, or mail for insurance‑related purposes; you can opt out at any time using our opt‑out mechanisms.
- During the Medicare Open Enrollment Period (OEP), we follow CMS rules regarding what is and isn’t permitted.
5) Scope of Appointment (SOA) & Appointment Timing
Before discussing Medicare Advantage (MA) or Part D plan benefits specific to you, MSHP obtains a Scope of Appointment (SOA) when required. CMS rules require a minimum 48‑hour window between SOA completion and the personal marketing meeting, subject to limited exceptions (e.g., beneficiary‑initiated walk‑ins; last 4 days of a valid election period).
6) Third‑Party Marketing Organization (TPMO) Disclosures (If/As Applicable)
CMS considers agents and brokers performing lead generation, marketing, sales, and enrollment functions as TPMOs; specific standardized disclaimers and oversight apply. Where applicable, our Site and communications will include required TPMO disclaimers (for example, “We do not offer every plan available in your area…”) and we will follow all TPMO oversight and disclosure rules (including not sharing beneficiary data with other TPMOs without prior express written consent).
7) Call Recording, Retention, and Compliance
To comply with CMS oversight and carrier requirements, MSHP may record and/or monitor marketing, sales, and enrollment calls and certain virtual meetings; we retain such records as required by law and plan contracts. CMS guidance confirms that all calls between TPMOs and beneficiaries related to marketing/sales/enrollment must be recorded.
8) Website Practices & Content Standards
We align our website practices with applicable CMS standards for Medicare communications (for example, maintaining current information and using clear disclosures or notices). CMS rules for MA organization websites include requirements such as timely updates and keeping MA content distinct from other lines of business.
9) Accuracy, Plan‑Year Changes & No Guarantee
Insurance products, premiums, benefits, formularies, networks, and eligibility change regularly and at least annually. We strive for accuracy but do not guarantee the completeness, timeliness, or correctness of Site content. Always verify details with carriers, CMS resources, or a licensed MSHP agent prior to enrollment. We disclaim liability for errors, omissions, or outdated content to the maximum extent permitted by law. (Plan‑year marketing/communications are regulated by CMS and have specific timing and accuracy requirements.)
10) Prohibited Inducements & Event Rules
We do not offer monetary inducements to enroll; nominal gifts, when offered, are provided without obligation to enroll and are not cash or cash equivalents. We do not provide meals at marketing events, nor do we cross‑sell non‑healthcare products during Medicare sales interactions.
11) Intellectual Property
All Site content (text, graphics, logos, trademarks, videos, downloads, and software) is owned by MSHP or its licensors and protected by applicable laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission, except as permitted by law.
12) Privacy & Data Protection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, disclose, and protect personal information, including sensitive beneficiary information. We maintain safeguards designed to protect personal data and follow CMS restrictions on extracting, sharing, or selling beneficiary information gathered through Medicare marketing activities. Please refer to our Privacy Policy for more detailed information.
13) By opting into our communications
Consent to Communications: You hereby consent to receive communication from our company through emails, autodialed and/or pre-recorded telemarketing calls, AI calls, and text messages (including SMS and MMS) from or on behalf of MSHP and our affiliated partners at the telephone number provided, including your wireless number, if applicable. You understand that consent is not a condition of purchase.
Frequency of Messages: You acknowledge that the frequency of messages from MSHP may vary. Standard message and data rates may apply to text messages.
Third-Party Communication: You agree that MSHP and its trusted partners may
contact you for marketing, promotional, and other purposes related to the services or products you have expressed interest in or that we believe may be of interest to you.

13) Accessibility

14) Third‑Party Links & Tools
The Site may link to third‑party sites, tools, or resources for convenience. We do not control and are not responsible for third‑party content, policies, or compliance. Your use of third‑party sites is at your own risk.
15) No Warranties; Limitation of Liability
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MSHP AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS/LIMITATIONS; IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
16) Indemnification
You agree to indemnify and hold harmless MSHP and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.
17) Changes to Terms; Plan‑Year Notices
We may update these Terms periodically. Changes are effective when posted with a revised “Effective Date.” We may also post clarifications to reflect CMS marketing calendars and plan‑year distinctions on relevant pages. Your continued use of the Site after changes constitutes acceptance.
18) Governing Law; Disputes
These Terms are governed by the laws of the State of California without regard to its conflict‑of‑law provisions. Any disputes arising from these Terms will be resolved in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction and venue.
